The Development Charge Background Study will help determine the additional capital related infrastructure the Town of Whitby requires based on the residential and non-residential growth forecast.

The Town of Whitby applies a Development Charge fee to new/repurposed development; the preparation of the study is legislatively required (at minimum every 5 years) under the Development Charges Act, 1997. The Town of Whitby completed its last Development Charge Study in 2016, and the Development Charge by-law was adopted by Council in 2017.

Development charges help the Town mitigate the additional growth-related costs from being be passed onto the taxpayer. Under legislative restrictions development charges cannot fully fund the cost of growth, however, the Town strives to ensure that growth-related development pays for the additional growth-related capital infrastructure needed, to the maximum amount allowable under legislation.

The information gathered through the Background Study will be used to calculate the amount of money that new development needs to pay through the Development Charges Fee in order to help cover new growth related infrastructure.

This study's focus is on Whitby's development charges, it does not include development charges applied by the Region of Durham or the School Board for new/repurposed development.

This study is being prepared in partnership with Hemson Consulting Ltd.

Development Charge By-Law Passed by Council

As of May 17, 2021, Council approved DC By-Law #7748-21, the updated development charge rates will come into effect as of June 1, 2021.

The Notice of Passing of a Development Charges By-Law #7748-21 will be published in the Whitby This Week newspaper on May 28, 2021 as per section 13(1) of the Development Charges Act, 1997, S.O. 1997, c.27. The full notice is available in the Documents section for review.

  • Development Charge By-Law #7748-21 Approved by Council

    As of May 17, 2021, Council approved DC By-Law #7748-21, the updated development charge rates will come into effect as of June 1, 2021.

    Section 18(2) and 18(6) of the by-law does include an administrative transition provision.

    18(2) Where Section 26.1 and Section 26.2 of the Act do not apply, the total amount of development charges shall be calculated and be payable pursuant to this bylaw as of the date the first building permit is issued.

    18(6) Notwithstanding subsection 18(2) of this by-law, when the total amount of development charges is to be calculated under the Act or this by-law as of the day the first building permit is issued, such calculation shall be subject to the following provisions:

    Complete building permit applications received prior to June 1, 2021 will be subject to the development charge rate in effect as of May 31, 2021 as long as all of the following conditions have been met:

    (a) the application has been considered complete within 15 business days of being received;

    (b) development charges have been paid in full prior to July 1, 2021; and

    (c) the building permit has been issued prior to September 1, 2021 and all other fees and charges have been paid in full. If an application is not complete, or if a building permit is revoked or not issued, it will be subject to the development charge rate in effect at the time of building permit issuance.

The purpose of this presentation will be to outline changes made to the DC Study, as a result of the public meeting held in early March and ongoing public consultation process.

  • DC Study - Update Notice March 16, 2021

    Further to the correspondence received for the Development Charge Study Public Meeting on March 8, 2021, the Town of Whitby will be providing written responses to the questions and issues raised in the upcoming weeks.

    Please note, new information is now available relating to the costing of the Brooklin Roads related projects; the Brooklin North Major Roads Environmental Assessment has now been released for the 60 day public review period. The BNMR EA project cost estimates were used to refine the road costs in the DC Study, although differences may still occur because the of site servicing and Regional costs included in the EA .

    Lastly, staff report FS 11-21 had identified that the new DC By-Law would be coming forward for Council’s consideration on April 26th. To allow for time to review all the public feedback, the new DC by-law is now scheduled to come before Council on May 17, 2021, with new rates in effect as of June 1, 2021.

    In advance of the public meeting on March 8, 2021, the 2021 Development Charge Background Study has been posted to the Town of Whitby's webpage on February 19, 2021. A copy off the study is now available in the documents section or through this link.

    The draft 2021 Development Charges By-Law has also been made available and is included as Appendix G of the DC Background Study.

  • Notice of Public Meeting Regarding Development Charges

    On Monday, March 8, 2021, the Town of Whitby will hold a public meeting about its proposed development charge rates and policies. The proposed development charges by-laws and rates will come into effect following approval at a date determined by Council.

    Ahead of the public meeting, a copy of the 2021 Development Charges Background Study will be available for review online at whitby.ca/developmentcharges by Monday, February 22, 2021.


    Development Charge Background Study

    Development charges are collected when there is new development in the Town. They are a primary source of funding for the Town to support growth-related capital costs in Whitby. Visit the Town’s Development Charges web page for more information.

    The 2021 Development Charges Background Study relates to the delivery of the following eligible development charges services:

    •Libraries

    •Parks and Recreation

    •Fire Services

    •Waste Management

    •By-Law Enforcement

    •Development-related Studies

    •Services Related to a Highway (Operations, Roads and Related – Town-wide Infrastructure, and Roads & Related – Alternate Route and Related Infrastructure) and;

    •Stormwater Management

    Public Comment and Appearing Before Council

    Any person may make written representation either in support of or in opposition to the study and/or by-law. Written submissions should be directed to the Office of the Town Clerk no later than noon on Friday, March 5, 2021.

    Any person wishing to speak at the meeting in support of or in opposition of the by-law should complete a Delegation Request Form online at whitby.ca/delegations by noon on the day of the meeting.

    Written comments received before the meeting and submissions made at the public meeting will be considered by Council before the new development charges by-law comes into effect.

    In response to Stakeholder feedback received on report CS 50-20, a virtual meeting has been scheduled for February 3, 2021 from 1-3:30 PM between various representatives from the Stakeholder Groups, Town of Whitby Staff and Hemson Consulting.     The Town of Whitby is seeking feedback on the DRAFT Development Charge Background Study information provided in Council report CS 50-20. This consultation period will be closing on January 8, 2021. Feedback can be provided directly on the Forum or by email to treasury@whitby.ca.
